More information has come to light following the indictment of Liberty County Pct. 3 Commissioner David Whitmire, who faces three felony charges: Official Oppression, Solicitation of Prostitution, and Sexual Assault.
As previously reported, the indictments stem from allegations made by a female complainant who claims Whitmire, while acting under the authority of his office, made unwanted sexual advances and offered assistance with her child custody case in exchange for sexual conduct. The third charge involves an alleged sexual act that the complainant says occurred without her consent.
The complainant previously identified herself in social media posts earlier this year. However, she is referred to anonymously in court documents, as her identity is now protected under court protocol.
The Official Oppression indictment accuses Whitmire of making sexual requests that were unwelcome and allegedly tied to the exercise or enjoyment of the complainant’s legal rights related to child custody.
Following the indictments, Whitmire was granted bond. The bond order, signed by Judge Kaycee Jones of the 75th State District Court, sets several conditions. Whitmire must report weekly to the Liberty County Office of Pre-Trial Services, avoid any contact with the complainant or her husband, and refrain from possessing firearms or ammunition. He is also subject to random urinalysis testing at his own expense.
These conditions are considered routine for felony defendants released on bond while awaiting trial.
No trial date has been set as of this report.
Whitmire’s attorney, Chris Tritico, has been reached but has not yet issued a public statement regarding the charges.
