The Montgomery County District Attorney’s Office has confirmed that three of the four charges filed against Liberty County Pct. 3 Commissioner David Whitmire have been dismissed.
The charges dismissed include Sexual Assault, Solicitation of Prostitution, and Official Oppression.
Each of those cases stemmed from a single complainant, who has now requested that the charges be dropped.
While those indictments are no longer moving forward, Whitmire still faces one remaining criminal case. The ongoing charge, Abuse of Official Capacity, is unrelated to the other three cases and was the most recent of the indictments filed against him.
All of the cases have been handled by the Montgomery County District Attorney’s Office after the Liberty County District Attorney’s Office recused itself from prosecuting them.
When asked for comment, Montgomery County First Assistant District Attorney Mike Holley said, “Mr. Whitmire maintains a presumption of innocence. We want to make sure this is done in the correct way and to the right resolution.”
He declined to provide any further details about the case, noting that it remains ongoing litigation and it would be improper to discuss specifics.

This guy makes the news alot. That was very nice of the complainant to request charges be dropped. You don’t see that happen very often. Was the complainant a man or woman?
Anytime a complainant drops the complaint, it usually do to being threaten by the abuser, the abuser is well connected, or some other nefarious reason.
