Murder charge filed against victim’s stepson in Dayton shooting

Liberty County Sheriff’s Investigator Travis Pierce just wrapped up the preliminary investigation into the fatal shooting of a Dayton man and arrested the victim’s stepson, Fabian Makell Miranda, 22, of Dayton, on a murder charge.

According to Capt. Ken DeFoor, spokesperson for the sheriff’s office, Miranda alleged that he had shot Moncivais in self-defense after Moncivais had been involved in a physical altercation with Miranda’s mother, Clarissa, at the family’s home on the 600 block of CR 685. The shooting was reported to law enforcement just before midnight Monday, Nov. 4.

“The evidence does not support the allegation of self-defense,” DeFoor said. “Murder charges were filed and Miranda was placed in the Liberty County Jail.”

Moncivais was killed by a single bullet fired from a 380 automatic handgun. The bullet hit Moncivais in the head, killing him. Pct. 4 Justice of the Peace Larry Wilburn has ordered an autopsy on the victim.

Miranda has not gone before a judge at this time, so bond information is not available.

  1. Need to correct the weapon used….was not “automatic”, it was “semiautomatic”. That makes a HUGE difference!
