Jurors in the 411th District Court, presided over by the Honorable Judge Wells, found Gary Lynn Ellis, 61, guilty of one count of Sexual Assault of a Child and one count of Indecency with a Child. The verdict was reached after testimony from eight witnesses called by the prosecution over two days.
During the punishment phase, the jury imposed a life sentence and the maximum fine of $10,000 on Ellis. Judge Wells ruled that the sentences would be served consecutively, ensuring Ellis will remain incarcerated for life. The prosecution was led by First Assistant District Attorney Rob Freyer and Assistant District Attorney Alyssa Marshall.
The case began in June 2022, when a 16-year-old girl was offered a ride to Livingston by a man she met while walking down FM 1097. This act of kindness turned into a harrowing experience as the girl was sexually assaulted in the man’s truck in rural San Jacinto County. After the assault, she was dropped off in Livingston and immediately reported the crime to her mother.
A medical examination conducted by Forensic Nurse Patricia Scofield provided evidence of the assault. Detective Sergeant Omar Sheikh of the San Jacinto County Sheriff’s Office spearheaded the investigation, obtaining video and cell phone records that corroborated the victim’s account. Forensic Interviewer Norma Carmona of Children’s Safe Harbor conducted a detailed interview with the victim.
DNA evidence from the medical examination confirmed Ellis as the perpetrator. Further investigation revealed Ellis was a registered sex offender, with a 1986 conviction for Burglary with Intent to Commit Sexual Assault. He also had convictions for Failure to Comply with Sex Offender Registration and Possession of a Prohibited Weapon.
First Assistant District Attorney Freyer and Assistant District Attorney Marshall expressed their satisfaction with the verdict, emphasizing the community’s commitment to protecting children.
“This verdict once again underscores the notion that the citizens of San Jacinto County place the highest value on its most important and precious resource – our children. This jury’s verdict demonstrates that when individuals come here engage in the most egregious acts known to man, that if the State identifies the perpetrators and proves their guilt, that there will be nothing short of such hell to pay for such awful and disgusting conduct,” the prosecutors said in a shared statement.
They also praised the collaborative effort in achieving the verdict, acknowledging the dedication of Sergeant Sheikh, Analyst Solis, Interviewer Carmona, and RN Schofield.
“This was a 100 percent team effort. We applaud and commend the hard work and dedication of Sgt. Sheik, Analyst Solis, Interviewer Carmona, and RN Schofield in achieving such a well-deserved results. We look forward to working with them and those who share their dedication in order to ensure the integrity of victims and the complete safety of the community. Such conduct is not and will not ever be tolerated here,” they said.
I suppose releasing sex offenders as well as murderers back into society to rape and kill again is the only way the justice system will lock these trash scum bags up indefinitely

It’s a scam that the mother and the girl run. They lure men in and claim this happened. She tells them she is 18 and legal then they do the do and then she lies and says this happened. Everything was consensual. They have put away 3 other men for this with life sentences. Gary is the victim her not the girl. The girl had semen in her when they did the kit and found 2 other samples from 2 other people.

A prior form 1986, some 38 years ago, was allowed to be introduced. Where’s the full truth of this egregious crime?

They had all the evidence in front of them and chose to convict him over anything else. This girl and her mom have put 3 other men in prison with life sentences for this scam that they run. Everything from my understanding was consensual and his attorney had evidence. But they disregarded it and took the girls side and took gave him 30 years a piece for these charges.

I have known Gary for over 30 years and there is no way that he raped this girl,,this was a consentual situation and she lied about her age. They should investigate the girl and her mother this is not the 1st time that she reported RAPE!!!! What’s wrong with the jurors? They most definitely did NOT look at the evidence of this case…2 LIFE SENTENCES?
