Jury sentences convicted child rapist to 60 years

A Liberty County Jury on June 20, 2024, found Marcus Anthony Diaz, 47, guilty of Continuous Sexual Abuse of a Child and sentenced him to a term of sixty years in prison at the conclusion of the two-day trial.

Prosecutor Nicole Washington presented evidence that Diaz began sexually abusing his first victim when she was just 8 or 9 years old. As the boyfriend of this victim’s mother, Diaz had almost complete access to her; sexually abusing her every other night for approximately 8 years while her mother slept in another bedroom.

Jurors also heard from Diaz’s second victim, who is the cousin of his first victim. She testified that on four occasions from ages 8 to 12 years old, the defendant sexually abused her. Both girls admitted to being afraid of Diaz because he threatened he would harm them. 

During punishment proceedings, the jury heard about Diaz’s criminal history, which included several prior prison trips. After considering all the evidence from trial and punishment proceedings, the jury sentenced Diaz to 60 years in prison. He will serve this sentence day-for-day and is not eligible for parole.

“For years, while we have all slept peacefully in our beds, these two girls endured the unthinkable. I am so proud of their courage, candor, and strength, and I hope that they, too, can sleep peacefully knowing that this defendant will never hurt them again,” said Assistant District Attorney Nicole Washington.

“This defendant betrayed someone he should have been protecting. This jury’s verdict guarantees that he will spend the next 60 years where he belongs; locked in a prison cell where he is unable to prey on young children. Our office and the law enforcement agencies in our county are committed to a safer community for our children. While we are unable to eliminate all abusers from our communities, this conviction ensured that one less predator walks our streets.   1. Now we get to support him for the rest of his life. BS. Cut his manhood off and let him bleed to death. Still wouldn’t be a smidgen of the suffering those two poor innocent children had to go through and will always have to live with.

  2. He got what he deserved thought he was invincible immune to everything because he said he was crazy.I am so thankful for Nicole Washington and so proud of my grand-daughters. And they do sleep easier at night but will never forget , and has also changed the closeness of family

  3. If it means supporting and keeping an atrocious of a creature away from children so in time the children’s nightmares will subside. He better be happy that punishment was not able to be handed down by the people here In Liberty County!

  4. He WILL NOT last long in prison. He will either kill himself or the inmates will use him up like he done those poor little babies but worse. Then they will do away with his lifeless body.
