Civil lawsuit challenges outcome of San Jacinto County sheriff election

A civil lawsuit has been filed in the 411th State District Court in San Jacinto County, contesting the results of the March 5 primary election. The lawsuit, brought forward by Sheriff Greg Capers against his opponent, Pct. 1 Constable Sam Houston, alleges various election irregularities that have raised concerns about approximately 503 votes in the race for sheriff.

According to the lawsuit, the purported outcome of the contest for sheriff is being disputed on the grounds that ineligible votes were cast and counted. It further claims that one or more election officers or other individuals involved in the election administration hindered eligible voters from casting their ballots by either failing to count legal votes, engaging in fraud or illegal conduct, or making mistakes.

The 24-page document also highlights that approximately 255 voters failed to register to vote on or before Feb. 5, 2024, which was the last day to register to vote in the March 5 Republican Primary. It also suggests that another 218 voters participated in the Republican Primary despite not being residents of San Jacinto County. Additionally the lawsuit alleges that roughly 30 felons also voted in the election.

In the final canvass of the election, Capers showed 2,887 votes to Houston’s 2,994, a difference of 107 votes, 1.82 percent of the total 5,881 votes.

The lawsuit suggests that the information can be proven in court, after which a new election will have to be ordered and held in the manner prescribed by the Texas Election Code.

While she is not named specifically in the lawsuit, Vicky Shelly, elections administrator for San Jacinto County, was asked to shed some light on the situation.

Shelly told Bluebonnet News that as this is active litigation, she has been advised to not make any statements to the media.

When asked for comment, Constable Houston said he is in the process of obtaining an attorney to represent him in the case.

“This came out of nowhere. As soon as I get information and am able to make a statement, we will discuss it more then,” Houston said.

A call for comment was made to Sheriff Greg Capers as well, but as of the posting of this article, the call has gone unanswered.

Capers has faced led to investigate any of the hate crimes against our church including the professional arson fire that totally destroyed our 1845 historic Harrell plantation house church and museum Capers said that tha fire never happened Our church and foundation have the victims of multimillions in damages

  2. This is so typical and pathetic. Sheriff Capers never thought for a minute he would be voted out bc he’s been in office so long. The people of this county finally just saw Capers for who he really is and that some people matter to him and some don’t, if your not in his favorite parts of this county you don’t matter. And crime is allowed to run wild and unnoticed. Capers and his actions or non actions have been investigated more times then should have been allowed, Mr Sam Houston who has been the Constable in San Jac County is always made his self available for all parts of this county and works above his actual responsibilities for the people. There was no cheating on this election. Nobody has really ran against Capers much is the only reason he’s been in office this long. Finally a man ran against him who is more then able to be a sheriff that’s fair and I believe truly cares for the people of this county without being judgemental of who you are, who you know and who lines whose pockets. The better man most definitely won the election fair and square. I’m sure it’s hard to walk away from the seat Capers has sat in so long, so comfortable and protected by his own of wrong doings. Maybe Capers if ever working in law enforcement anywhere else people’s lives will actually matter no matter what subdivision they live in. Now times up.

    Same shit in Montgomery County… criminal beaners turning our county into a third world cesspool, crime in the neighborhoods where they nest, but sporadic police response.

  4. If it’s true that, that many illegal voters were allowed to vote, then we need a Grand Jury investigation into Vicky Shelly’s Office as election Administrator. Thats her job to clean up the election rolls.
