
Liberty County commissioners on Tuesday, Aug. 11, approved an agreement allowing the Pct. 4 Constable’s Office to participate in the U.S. Immigration and Customs Enforcement 287(g) Task Force Program, a move that will give participating deputies authority to perform certain immigration enforcement functions under ICE supervision.
The action was taken during the Aug. 11 meeting of the Liberty County Commissioners Court. The agreement also authorizes the county to accept federal funding, reimbursements, stipends and other program-related payments associated with Pct. 4’s participation.
County Attorney Matthew Poston told commissioners the program includes a financial component that could provide approximately $120,000 initially for equipment, including a new vehicle and necessary components. The county also could receive reimbursement for salaries of deputy constables while they are performing eligible duties under the agreement.
“When they go out and make an arrest or they’re going out, and under the agreement, enforcing immigration law, then the county can receive compensation for their salaries for that. There are two agreements. One that kind of dictates how the constables will perform those duties – the required training. Then there is this one, which is the financial component that is before you. It requires the tracking of payments, reporting of hours, all of that. There is a lot of record keeping,” Poston said.
Pct. 1 Commissioner Bruce Karbowski questioned how the federal money would be handled and emphasized the importance of county oversight. During the discussion, officials said the funds would be audited and would have to be used by the participating constable’s office rather than redirected to another county department.
Pct. 4 Deputy Constable Brian Nichols, who spoke to commissioners about how the program would work in practice, said participation is not expected to significantly alter the office’s normal duties. Nichols said deputies will continue performing their regular law enforcement responsibilities, including serving papers and conducting traffic stops.
When deputies encounter someone during those duties who presents identification such as a foreign passport or foreign identification card, Nichols said circumstances could give deputies reasonable suspicion to check the person’s immigration status through ICE records. ICE would then determine whether the person should be detained.
Nichols said he and another Pct. 4 deputy will be involved in the program and its required paperwork for the Pct. 4 Constable’s Office.
He also told commissioners that ICE officials have indicated eligible work performed by participating deputies as part of their normal duties could qualify for federal reimbursement. That could substantially offset the county’s salary costs for those deputies.
The discussion also addressed what happens after ICE authorizes a detention. Officials said ICE has contracted with another agency to handle transportation, with an anticipated response time of about 30 minutes. Under that arrangement, Pct. 4 deputies would not routinely have to transport detainees themselves.
Federal reimbursement will not simply be paid upon submission of an invoice, officials explained. Documentation of hours and activities will first be reviewed at the federal level, where reimbursement requests can be approved or returned for additional information. The documentation will then go through the county’s financial processes.
The agreement approved Tuesday applies specifically to the Pct. 4 Constable’s Office. During the discussion, Poston said the other five Liberty County constable offices have also signed agreements related to the program and additional agreements are expected to come before Commissioners Court. Poston said there is considerable interest among the other constable offices in participating.
The Pct. 4 office is the first of Liberty County’s six constable offices to be accepted into the program.
Commissioners approved the agreement without opposition.

If you’ve ever looked at the county arrest records, you would see a distinct pattern pointing toward the problem demographic- especially when broken down by ethnicity and a per capita basis.
The problem is scum from south of the border- mestizos. Lack of a developed prefrontal cortex means they can’t control themselves, can’t be civilized, and won’t assimilate. I’ve personally had enough all-night music, gunfire outside my kid’s window at 3am, dumped trash and dead animals, and general trash behavior.
