On Jan. 24, 2025, at approximately 5:15 p.m., deputies from the Montgomery County Sheriff’s Office District 2 Patrol responded to a report of a robbery in progress at the Wendy’s restaurant on Sawdust Road.
Deputies arrived promptly at the scene and apprehended the suspect, identified as Nicholas Xavier Rivas, while he was allegedly still committing the robbery.
Rivas, a documented gang member from Houston, Texas, was arrested without further incident and transported to the Montgomery County Jail.
Rivas has been charged with felony robbery and is being held on a $75,000 bond.
According to a statement from Montgomery County Sheriff’s Office, “The swift actions of these deputies send a clear message to gang members who believe they can come to Montgomery County and commit violent crimes: such lawlessness will not be tolerated. Those who engage in criminal activity will be arrested and prosecuted, and justice will be served.”
